ZADAR ARCHIPELAGO (hereafter referred to as “Zadar Archipelago”, “Archipelago”, “we”, “us”, or “our”) is protected brand name for tour operator that offers, organizes and performs a variety of tours, tickets and tourism services (“Products”). Products are available to anyone who complies with requirements of this Terms & Conditions.
We provide information to anyone on basis of our Services, our knowledge, expertise and professional experience. We are using all available channels of offline and online communication (brochures, leaflets, personal contact, direct sales, our agency office point of sale, other points of sales, website, social networks and all other, hereafter referred to as “Communication Channels”) to establish communication with anyone who might be interested in our Products. Collectively, all the actions we undertake in order to communicate, attract, inform, sell, organize, perform and all other actions regarding our Products we call our Services. We say we provide Services to anyone who is interested in our content through all Communication Channels. Zadar Archipelago is using all Communication Channels including this website (domain name www.zadar-archipelago.com; “Website”) to provide information and assist customers and visitors in gathering and searching for travel excursion information and booking reservations, buying tickets for Products, and for no other purposes.
The term “you” refers to the customer, guest interested and using our Services, visiting any Communication Channel including this Website and/or contributing content on this Website. “Your group” means all persons booked and going on the same trip same day with you no matter you do or do not know them personally. (Including anyone who is added or substituted at a later date).

Our Services and the Products made available are offered to you conditioned upon your acceptance without modification of any/all the Terms & Conditions, together with our Privacy Policy (the “Privacy Policy”) and notices set in this document (collectively, the “Agreement”). By using our Services in any manner, you agree to be bound by the Agreement and represent that you have read and understood Agreement.
Please read the Agreement carefully, as it contains information concerning your legal rights and limitations on these rights, as well as a section regarding applicable law and jurisdiction of disputes. If you do not accept all of these Agreement, please do not use our Services or book any of our Products.
In all booking arrangements, the person making the booking shall be deemed to have accepted Agreement on behalf of the persons named in the booking. If you book services via a linked partner either in person or on some other online platform or if a sub-intermediary makes a booking on behalf of you, once your personal details are submitted, and the intermediary or our voucher or confirmation is issued, it is considered that Agreement is concluded and you accept these Terms & Conditions.
These Terms & Conditions only apply to our Services and Products which you book with us and which we agree to make, provide or perform (as applicable) as part of our Agreement with you. All references in these Terms & Conditions to “holiday”, “booking”, “contract”, “package”, “tour” “arrangements” or “travel arrangements”, “day trips”, “day tours”, “private”, “transfers”, “excursion” mean such holiday arrangements.
A very binding Agreement for your particular travel arrangement (your purchase of our products & services) between you and us comes into existence when we dispatch our confirmation email – voucher, mobile phone message (SMS or and WhatsApp) with voucher details or physical voucher to you. We both agree that Croatian Law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us.
Modification
Zadar Archipelago reserves the right, at our sole discretion, to modify the Website, Products, information, Communication Channels and Services at any time and without any prior notice. If we modify these Terms & Conditions, we will post the modification on the Website. You will be also able to receive the most current Terms & Conditions along with your travel documents at the Archipelago office prior your tour starts. We will also update the “Last Updated Date” at the top of these Terms & Conditions. Any changes will become effective immediately. If the modified Terms & Conditions are not acceptable to you, your only recourse is to cease using our Services.
How this works?
You use our Services to gather information, facilitate the Products, searching, comparing, meeting other people, booking reservations, going to the tours (“Group Tours” or “Private Tours”), cruises and other types of activities, payments, communication. Anyone can see, review and book the Products using our Services as long as it complies with requirements of this Terms & Conditions. When you get to the decision to book some of our Products, buy and pay for our Products, you must follow certain steps and provide us with personal information. By using our Services, you acknowledge that you accept the practices described in our Privacy Policy as one of the essential parts of this Terms & Conditions, as well as your Agreement with us.
You can use our Services available through all Communication Channels. You can book and pay our Products only at Archipelago office, Website (online payment gateway) or through network of partners. Online booking at our Website is the most accurate, easiest and the best way to book our Products.
Eligibility
By using our Services, you warrant that you are 18 years of age or older, that you possess the legal authority to enter into this Agreement, use this Website, book the Product, and that all information you supply are true and accurate. You further agree that you will use the booking functionality of this Website and other Communication Channels to make only legitimate reservations for you or others for whom you are legally authorized to act. Any false or fraudulent reservation is prohibited. Any access to our Website or uses of the Services by anyone under 18 is expressly prohibited. By accessing or using the Services you represent and warrant that you are 18 or older.
Third party content, links to other websites
Zadar Archipelago does not assume any responsibility for third party content (including any activities available for booking requests, and information relating to such activities) that may be available to you by using our Services, through the Website and our other Communication Channels, and for content linked to the Website and our other Communication Channels or which are linked to from it or referred to. Zadar Archipelago does not recommend or endorse such content, and will not have any liability relating to it. Where Zadar Archipelago links to third party websites, you use such websites at your own risk. We recommend reading the policies of these websites and review how these websites may process personally identifiable data relating to you. If you think we have illicit content on the Website and our other Communication Channels, please send an email to base@zadar-archipelago.com.
Data protection
Zadar Archipelago collects and uses personal data of users to the extent that is necessary for the communication, creation, design of content or modification of Services and the contractual conditions for Zadar Archipelago between you and us.
If Zadar Archipelago is involved in the communication for a Service agreement between you and the third-party Supplier, we will transfer the data required for this agreement to the respective Supplier. This Supplier processes and uses the data to initiate, conclude and execute the contract on its own responsibility.
Zadar Archipelago reserves the right to take photographic or film records of any of our tours and may use any such records for promotional and/or commercial purposes.
Language, time zone and jurisdiction
Zadar Archipelago is local, Croatian company, based in Croatia, we operate under Croatian law. All disputes arising out of using our Services, this Terms & Conditions, this Agreement or related to its violation, termination or nullity shall be finally settled under Croatian Law, at the Court in Zagreb.
Our first official language is Croatian. Our second language is English and you will find us communicating in English, UK most of our time. All our Services are available in English, and all our tours are guided in English and Croatian.
For calculations of the time and deadlines, the time zone of city of Zadar, Croatia is authoritative. Central European Time, (CET).
Exchanging information with you
In the interest of quick processing, it is recommended that all communication and messages between you and us is done in the written way through the e-mail on base@zadar-archipelago.com and or through our booking engine on the Website.
The details transferred via the Zadar Archipelago Communication Channels must be truthful. Zadar Archipelago reserves the right to withdraw from the Agreement or to exclude users from participating in the Service and to demand compensation amounting to the cancellation costs defined in this Terms & Conditions, if defective details are provided by the user.
When you use our Services, or send e-mails, phone call, text messages, and other communications from your desktop or mobile device, you are communicating with us electronically and agree that we may communicate with you in a variety of ways, such as by e-mail, phone call, text messages, or in-app push notices – messages, or by posting notices and messages on the Website and our other Communication Channels. You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, content, software, products, or services obtained from or through this Website and other Communication Channels. Any other use of zadar-archipelago.com content requires the prior written permission of Archipelago.
Additionally, you agree that you will not assist or enable others to:

Please note, the information and prices shown on our Communication Channels may have changed by the time you decide to book your travel arrangements.
We reserve the right to make changes to and correct errors in advertised prices at any time before your travel arrangements are confirmed. Whilst every effort is made to ensure the accuracy of the website/brochure and prices at the time of publication, regrettably both, changes and errors do occasionally occur. You must therefore ensure you check all details of your chosen travel arrangements (including the price) with us at the time of booking. If you feel that changes to any of the Services mentioned on our website or brochure are vital to the enjoyment of your holiday, write to us immediately and we will tell you the latest known situation.
Liability
The decision to use our Services and the consequences of doing so are entirely at your own risk. By using our Services, you acknowledge that you have read, understood and agree on this Terms & Conditions, all rules, warnings and restrictions related to using our Services. By using our Services, you acknowledge and you understand that all the risks of using our Services and activities associated with our Services are at your own risk and your own responsibility. By using our Services, you acknowledge and you understand that Zadar Archipelago shall not be and is not responsible for any injuries or losses sustained by you, your group, or any other customer, before, during and after using our Services and / or attending our tours.
You understand and you agree that neither Zadar Archipelago, nor any of our respective employees, agents or partners may be held liable or responsible in any way for any occurrence on your tour or by using our Services, which may result in personal injury, property damage, loss, or wrongful death or other damages to you, your family, personal belongings, your group or estate that may occur as a result of your participation in our tours or by using our Services.
Additionally, you agree to be held solely responsible if your negligence, wilful misconduct, or disregard for the Croatian Law, this Terms & Conditions, rules of behaviour and other rules that apply before during and after using our Services and tours, leads to damage to others or to Zadar Archipelago property.
Children, infants, all guests and any participants who are a minor (under 18 years old) at the time of attending, are not allowed to use our Services and participate our tours if they don’t have their legal guardian approval and if they are not escorted by their legal guardian who takes full responsibility for their behaviour and all risks that are mentioned above. Zadar Archipelago shall not be and is not responsible for any injuries or losses sustained by children, infants, all guests and any participants who are a minor (under 18 years old) at the time of attending our tours.
You also understand and you agree that if you are escorting children, infants, all guests and any participants who are a minor (under 18 years old) at the time of attending our tours and who are using our Services, you are held solely responsible for them. If their negligence, wilful misconduct, or disregard for the Croatian Law, this Terms & Conditions, rules of behaviour and other rules that apply before during and after using our Services and tours, leads to damage to others or to Zadar Archipelago property. We don’t accept any liability for any business losses, external and additional costs (hotel, tour operator, cruise ship, transfer…) all other which happened to you or you, your family or your group, by using our Services.
Zadar Archipelago and our own agents and employees, sub contractual partners and suppliers shall not be liable for any delay, expense, mishap, inconvenience, bodily injury or death to person, or damage to property occasioned through the conduct or default of any company or individual engaged in providing our Services.
Zadar Archipelago shall not be liable for bodily injury or property damage for any reason, including but not limited to acts of God, detention, annoyance, delays and expenses arising from quarantine, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulation, discrepancies or change in transit over which it has no control.
All of our guests or / and their legal guardians (for minors) are required to sign a liability release form acknowledging that there are inherent risks associated with the nature of activities planned prior to traveling with Zadar Archipelago and / or using our Services. Your trip is not confirmed until Zadar Archipelago receives this signed liability release form. Participation in the tour will not be allowed without a signed completed liability release form, and consistent with Zadar Archipelago cancellation policy, no refund will be granted.
Zadar Archipelago excludes our liability, and that of our all employees and officers, agents and independent contractors, and its and their employees and officers, and its sub-agents or distribution partners for damages relating to your access to using our Services or inability to access our Services, the Website and our other Communication Channels, or to any errors or omissions, or the results obtained from the use, of the Website, our Services, the Website and our other Communication Channels, whatever the legal basis of such liability would be.
Zadar Archipelago takes no responsibility and assumes no liability for any content posted, stored or uploaded on our Communication Channels especially content uploaded by you or any third party, or for any loss or damage thereto, nor is Zadar Archipelago liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, Zadar Archipelago is not liable for any statements, representations or content provided by in any Communication Channel.
Force Majeure
Except where otherwise expressly stated in these Terms & Conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of force majeure. in this Terms & Conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
Insurance
By using our Services, you understand and you agree that you are indeed self-responsible for your own, your family, your group insurance. Product(s) price does not include insurance. You are responsible for providing sufficient insurance protection. The requirement for your insurance depends on your life being, personal behaviour, on nature of the Product and on the activity you booked.
We strongly recommend that you purchase a comprehensive travel insurance policy prior to departure to protect your Product purchase. If you cancel your trip or significantly alter travel dates, your travel insurance policy may reimburse the cost of cancellation fees and related expenses. Please review your travel insurance policy carefully for related terms and conditions. Please make sure that you are familiar with and you understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Travellers while participating in our tours and activities.
We strongly recommend that you protect yourself, your family, your group and your equipment through the purchase of a short-term travellers’ insurance policy, covering all risks, including: baggage, accident/life and trip cancellation. Baggage and personal belongings are carried entirely at your -owner’s risk, and Zadar Archipelago accepts no responsibility whatsoever for loss, damage, or delayed property. Zadar Archipelago assumes no liability regarding provisions of medical care. Participants should realize that hospital facilities for serious problems may be remote and evacuation prolonged and expensive. Participants are urged to check their medical coverage to be sure it is adequate. We also advise you to purchase cancellation insurance, as the policy will cover any deposits paid if you need to cancel for covered reasons. Participants are responsible for researching the terms of their insurance coverage.
Special requests and medical problems
It is your responsibility to consult your physician, doctor or responsible person for current recommendations on inoculations before you travel internationally and to ensure that you meet all health entry requirements and follow all medical guidance related to your tour. You have the responsibility to choose a trip appropriate to your abilities and interests. We are happy to discuss this with you. You are held responsible for being in sufficient good health to undertake the trip and for preparing for the trip by studying the itinerary and all pre-departure information which can be found on our Website and sent by us.
Most of our Products are suitable for everybody from early beginners; however, some are more active, physically challenging or demanding than others. A spirit of flexibility and adventure is a good thing to bring along. It’s important that you understand the physical requirements for whatever Product you choose. If you’re not sure if an itinerary is right for you, please call us for advice. If you have any medical concerns, we encourage you to speak with your doctor before making a reservation.
Without exception, expectant mothers are not permitted onboard our tours at any stage of their pregnancy. Zadar Archipelago advises you not to travel if you have any historical or current backbone conditions or complaints. Be advised the sea is an ever-changing environment and the vessel may be subject to unpredictable movements. We are not medical experts so are unable to assess every situation individually; we simply advise you do not travel with us.
All boats can experience unpredictable movements that could aggravate existing medical conditions. Prior your tour starts, you must inform us of any material fact, including medical conditions or disabilities, which may affect the skipper’s decision to carry you as a passenger, especially epilepsy, dizzy spells, diabetes, angina or any other heart conditions, back/bone conditions and pregnancy (this is not an exhaustive list).
If you have any special request, you must advise us in writing at the time of booking. Although we will always try to meet and satisfy all requests, we regret we cannot guarantee any request will be met unless we have specifically confirmed this in writing. Failure to meet any special request will not be a breach of contract on our part. Understand that, unless and until specifically confirmed, all special requests are subject to availability.
For your own protection, you should obtain confirmation in writing that a special request will be complied (where it is possible to give this) where it is important to you. We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests.
If you or any member of your group has any medical problem or disability which may affect your holiday or has any special requirements as a result of any medical condition or disability (including any which affect the booking process), please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements and/or making the booking. In any event, you must give us full details in writing at the time of booking and at least 5 working days before your tour starts and whenever any change in the condition or disability occurs.
You must also promptly advise us if any medical condition or disability which may affect your holiday develops after your booking has been confirmed. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking or the condition/disability develops after booking, cancel when we become aware of these details. In case of late notice from your side we reserve the right to act on Cancellation policy as it is stated in this Terms & Conditions.
Your behaviour
All our products have general rules of guest behaviour explained in the product section on our Website. When you book with us, you agree that you must comply with our rules of behaviour. You also accept responsibility for any damage or loss caused by you or any member of your group. Full payment for any such damage or loss must be paid direct at the time to the captain or base manager.
We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your group behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without any prior notice, to immediately terminate the travel arrangements of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the vessel or other service concerned. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.
Product Price
Prices listed on the Website and our other Communication Channels are per person for cash payments, unless otherwise specified. All prices on Website are quoted per person and include VAT (Value Added Tax). Local taxes may be charged on site. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Zadar Archipelago. We display our prices in Euro € to help our guests compare and understand prices. All payments are done in Croatian Kuna. Price quotations are subject to change without notice, until a booking has been confirmed.
Displayed prices are for cash payments only (Cash Discount Price), alternatively if you wish to use a credit card, PayPal for final payment, you may do so for an additional administrative fee, or service charge. Find more about that in Payment Terms.
Unless otherwise specified, prices do not include any service charges for online and other type of payment, local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.
Prices also do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed under inclusions on the Product pages of the Website. The price of the services does not include insurance. You are responsible for providing sufficient insurance protection. The requirement for insurance depends on the activity booked.
You understand and agree that you are solely responsible for determining your applicable Tax reporting requirements in consultation with your tax advisors. Zadar Archipelago cannot and does not offer Tax-related advice related to any Products or / and Services.
Each product has different price structure depending on the activities and availability. Most accurate information you will always find under Product (Tours) section on Website.
The prices on our website and in our marketing, literature is correct at time of publishing. These prices are subject to change and may alter due to international currency fluctuations, increased costs to ourselves, and other unforeseen circumstances.
We reserve the right to make changes to and correct errors in advertised prices at any time before your travel arrangements are confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. Please note, changes and errors occasionally occur. You must check the price of your chosen travel arrangements at the time of booking.
If you are happy with the service you receive, your tips and gratuity will be more than welcome. Tipping is a very personal matter and the decision to tip and how much to give is entirely yours. If you believe your guide deserves a tip, a suggested range is from 8-12% of your trip cost. If you had the time of your life, then the sky’s the limit! We also appreciate your comments. Booking
Early bookings are recommended as space is limited to only 12 adult guests per one group. While it is often possible to join one of our tours on short notice, space is limited and we highly recommend you to do your bookings well in advance.
Depending on tour type a minimum of four to six adult passengers is permitted for start of each group tour, except for the private tours or at the absolute discretion of Zadar Archipelago. Although it happens very rarely and almost never, tours that are not filled by the minimum number may be rescheduled, delayed and / or cancelled. Passengers will be contacted to arrange an alternate date and/or time to travel. For more details see in Cancellation Terms and Tours Schedule Terms.
If your preferred tour is already sold out and you are unable to switch for another tour or reschedule for another day, we might offer you to sing up at the waiting list. If you wish to be waitlisted for your preferred tour, full payment is also required. If an opening occurs prior the tour starts, you will be informed and immediately be welcomed on board. Your prompt answer will be expected in such circumstances. If you accept the slot you will be subject to the normal cancellation policy. Otherwise, your payment will be refunded in full.

While booking our Product(s) please be aware of the following details, rules and terms (“Booking Terms):
To confirm your booking you will need to provide us with certain personal information such are your: NAME, LAST NAME, BILLING ADDRESS, CITY & COUNTRY OF ORIGIN, MOBILE PHONE NUMBER (available and in use while being in Zadar, Croatia) where we can reach you if something goes wrong, E-MAIL ADDRESS which you will use to receive confirmation and further details about your tour, ACCOMMODATION DETAILS which we need in case something goes wrong and we cannot reach you, NUMBER OF PEOPLE in your group who are attending the tour, PRODUCT NAME, DATE and TIME.
Please note that you will need to bring with you on your tour, your TRAVEL DOCUMENTS. At the day of your tour, on your check-in you will need to identify yourself with valid travel document PASSPORT and /or IDENTITY CARD.
To confirm a booking, you must provide us with the correct information, either through our online booking form, through email, by phone, or personally in our office. This must be signed by the first named person on the booking. You must be at least 18 when the booking is made. You must be authorised to make the booking on the basis of these Terms & Conditions by all persons named on the booking and their parent or guardian for all group members who are under 18 when the booking is made.
To confirm your booking and book your seats, you must pay and we need to receive payment for your order in full at least 48 hours prior your tour starts. Depending on the booking method you will be able to pay for your booking in different ways. We accept PayPal, all major credit and debit cards, bank transfers and cash payments. All prices on the Website are final for cash payments only. Alternatively, if you wish to use a credit card, PayPal for final payment, you may do so for an additional administrative fee, or service charge. Find more about that in Payment terms
Once we have received your booking and all appropriate payments, we will, subject to availability, confirm your tour by sending you a confirmation email or voucher. This email or voucher will be sent to the e-mail address you provide us during your booking. Please check this email or voucher carefully as soon as you receive it. Contact us immediately if any information which appears on the email or voucher or any other document, appears to be incorrect or incomplete as it may not be possible to make changes later. You acknowledge that the availability and price of a Product can change at any time until you have received a booking confirmation e-mail.
A very binding Agreement between us comes into existence when we despatch our confirmation email or voucher to you after we have received full payment from your side. We both agree that Croatian Law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us.
Aborted bookings and bookings with non-complete payments are not considered as a booking and will be put at the waiting list and not be served. We reserve the right to cancel your booking if full payment is not received latest 48 hours prior your booked tour starts.
We regret we cannot accept any liability if we are not notified of any inaccuracy in any document within 48 hours prior your tour starts. We will do our best to rectify any mistake notified to us outside these time limits but you must meet any costs involved in doing so.

Please note – Sometimes emails sent to other email addresses go astray or are undeliverable. We try hard to answer all emails within 24 hours of receiving them (48 hours max). If you have not heard back from us within 24 hours it is likely that we have not received your email or that we have sent you one back but it is not in your inbox. Payment
Full payment is required to complete your booking, latest 48h prior your tour starts. Depending on the booking method (Online, In Office, Phone Call or E-Mail) you will be able to pay for your booking in different ways. All prices advertised through Communication Channels (on the Website, printed brochures, etc.) are final for cash payments only. Alternatively, if you wish to use a debit, credit card or PayPal for final payment, you may do so for an additional administrative fee, or service charge.
For online payments Zadar Archipelago use PayPal payment gateway and once forwarded to PayPal for your payment you will be able to pay with following credit or debit cards: Maestro, Mastercard, Visa, American Express, Discover. All online payments are subjected to 2.5% service fee. All currency conversions are set to the standard rate on the day that you pay your payment (the exchange rate is set by PayPal not by us). To save any conflict over exchange rate, we require that all deposits are sent Croatian Kuna (HRK) in which can be done using PayPal in any country.
For payments in our office, the best is to pay in cash, but we also accept following credit and debit cards: Mastercard, Maestro, Visa, Visa Electron, Discover. All non-cash payments in our office will be subjected to 2.5% service fee.
The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on Zadar Archipelago Website and your receipt and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees. Please note for bookings made in Brazil, the tax IOF (Tax Upon Financial Operations, 6.38%) is not included in the final booking value and will be charged to the credit or debit card used to make the purchase.
Tour Time Schedule
Modifications & Amendments made by Zadar Archipelago
Zadar Archipelago reserves the right, either prior to or after departure of the tour, in its good-faith discretion and in circumstances that warrant it, to change any tour, plan and schedule of the tour, trip, or activity. This includes the possibility of moving to an alternate location, changing time schedule, rescheduling or cancelling the tour due to extreme water conditions, wind conditions, forest fires, road closures and/or acts of God. In the event of such circumstances Zadar Archipelago will not be liable for replacement tickets and/or refunds and shall have no liability to you whatever, including liability for travel expenses or any other out of pocket expenses.
We will use all reasonable endeavours and it is in our best interest to ensure that our tours operate. However, we reserve the right, in our absolute discretion, whether for safety reasons or otherwise, and with or without prior notice, to cancel any tour prior to the departure. In the event of such cancellation, Zadar Archipelago will fully refund any guest whose tour is cancelled, the cost of his or her prepaid ticket, but otherwise shall have no liability whatever, including liability for travel expenses or any other out of pocket expenses, in respect of the cancellation.
Zadar Archipelago reserves the right to postpone, reschedule, cancel and / or offer a different tour (alternative solution) to all the guests who booked the tour which has less than minimum number of passengers that is permitted for start of that particular tour. In the event of such circumstances, we will postpone the departure of the tour up to maximum of 90 minutes. If we still not fill up the minimum number of people that is permitted for start of that particular tour, the tour will be rescheduled or / and cancelled. If we reschedule the departure of the tour, for another time on the same day or another day, guests will be offered to join rescheduled tour. In such circumstances, guests can be also offered to join another available tour and exchange their tickets for another tour tickets. As prices for different tours are variable in such case guests will be either reimbursed or they will be need to pay price difference prior tour starts. If the same guests refuse to join rescheduled tour, or different tour due to their travel plans, Zadar Archipelago will fully refund cost of his or her prepaid ticket, but otherwise shall have no liability whatever, including liability for travel expenses or any other out of pocket expenses, in respect of the cancellation.
We watch the weather forecast closely every day, hour by hour and if the weather is unsafe to take the tour, we will postpone, change, reschedule or cancel the tour. Zadar Archipelago reserve the right to move your booking time or day due to operational needs, weather circumstances, or due to other company commitments. Sometimes governing body involvement may result in changes becoming necessary. We do operate our tours in the light rain, up to moderate winds and any other weather conditions that nature decides to throw at us. After all, we’re going on adventures. We don’t operate tours in unsafe weather conditions.
When outside the marina dock, while operating the tour, Captain and Tour Leader reserve the right to make decisions on the spot and after departure of the tour Zadar Archipelago reserves the right to change the tour itinerary, tour schedule, route and activities in order to protect the safety of the passengers and the boat. In the event of such circumstances Zadar Archipelago will not be liable for replacement tickets and/or refunds and shall have no liability to you whatever, including liability for travel expenses or any other out of pocket expenses.
We define unsafe weather if the current conditions prior to departure of the tour can be described as: *outside air temperature below 5 degrees Celsius, *wind speed above 50 knots, *heavy rain more than 30 mm/3h constantly and in past 6 hours prior tour starts. If the weather is unsafe prior to the departure of the tour, tour can be postponed, rescheduled or cancelled.
If the weather is unsafe prior to the departure of the tour we will postpone the departure of the tour up to maximum of 90 minutes. If the weather does not get better in 90 minutes prior to new postponed departure, the tour will be rescheduled or / and cancelled.
If we reschedule the departure of the tour, for another time on the same day or another day, guests will be offered to join rescheduled tour. If the same guests refuse to join rescheduled tour due to their travel plans, Zadar Archipelago will fully refund any such guest who’s for the cost of his or her prepaid ticket. Otherwise Zadar Archipelago shall have no liability whatever, including liability for travel expenses or any other out of pocket expenses, in respect of the cancellation.
In unsafe weather circumstances for particular tour, guests can be also offered to join another available tour and exchange their tickets for another tour tickets. As prices for different tours are variable in such case guests will be either reimbursed or they will be need to pay price difference prior tour starts. Zadar Archipelago shall have no liability whatever, including liability for travel expenses, taxi, transfers or any other out of pocket expenses, in respect of the event when guest are exchanging the tour.
Zadar Archipelago reserves the right to change the itinerary of the particular tour either prior to or after departure due to various unforeseen weather circumstances. Please note that due to the nature of our itineraries and the fact that many of the ports we dock at are small and/or often busy it is not always possible for our ships to dock at all ports as planned. Unfortunately, this is an inherent risk in cruising in and around Croatia and we have no control over this. We will of course use all reasonable endeavours to dock at all scheduled ports but would expect from you and ask that you to allow for some degree of flexibility in itineraries when travelling with us. In the event of such circumstances Zadar Archipelago will not be liable for replacement tickets and/or refunds and shall have no liability to you whatever, including liability for travel expenses or any other out of pocket expenses.
In the unlikely event that the vessel has to make an emergency return to the Home Port or Operating Location (or any other along route), emergency or force stop due to health conditions of any traveller or crew member on board or due to weather circumstances, Zadar Archipelago will not be liable for replacement tickets and/or refunds and shall have no liability to you whatever, including liability for travel expenses or any other out of pocket expenses.
Tours requires a flexible attitude. Due to factors out of our control, including but not limited to weather, unannounced road construction, etc., delays do occur. We advise you to consider these potential factors when planning your travel to our tour destinations, as well as ask for your flexibility and understanding when delays due to factors out of our control necessitate changes to your tour itinerary. Zadar Archipelago reserves the right to deviate from a tour’s planned route and time schedule. Due to the nature of the business sailing times cannot be guaranteed, however, every effort will be made to keep on schedule. Speed restrictions apply at certain points along the marina, islands, channels and Zadar Archipelago works closely with the Croatian Naval Coast Guard Authorities to ensure we maintain high levels of customer comfort and safety. In the event of time schedule deviation Zadar Archipelago will not be liable for replacement tickets and/or refunds and shall have no liability to you whatever, including liability for travel expenses or any other out of pocket expenses.
Modifications & Amendments made by you
If from any reason you need or want to transfer your booking – payment to another trip you can do it latest 48 hours prior to departure, no questions asked and without any penalty. Bear in mind that early bookings are recommended as space is limited to only 12 adult guests per one group. While it is often possible to join one of our tours on short notice, space is limited and we highly recommend you to do your bookings well in advance. Within 48 hours prior to departure of your booked tour you are subject to the applicable cancellation fees stated above and below.
If you are unable to go on the tour, you are welcome to find a replacement for yourself. Any replacement participant must be able to meet tour criteria, complete a trip application, sign a liability release waiver form and agree to the Terms and Conditions. Please understand that once you’ve signed up, we lose the right to sell your reserved space to other individuals or groups. Therefore, we regret that we cannot make exceptions for personal emergencies. For this reason, as well as those listed above and below, we strongly recommend you consider purchasing a travel protection plan.
Arrival at the meeting point
You are responsible for arriving on time at the notified meeting point. You are responsible for having the necessary travel documents (passport, ID, etc.), and for observing the health regulations etc. the same is valid for every passenger on board of our tours, every member of your group.
All passengers should arrive at the Check In Operation Location (Zadar Archipelago Office – Obala kneza Trpimira 2, 23 000 Zadar, Croatia, EU) no less than 30 minutes prior to the tour departure time. Please be aware if you miss your scheduled departure you will not be eligible for a later booking or refund. If you are not present upon check-in for your pre-booked departure time our boarding team will endeavour to contact you, please ensure you provide us with a mobile telephone number that your lead passenger will have with them on the booking day.
Zadar Archipelago will prioritise all customers against their booking times and never allow late running customers to have an impact on later departure times. Zadar Archipelago are not responsible for factors out of our control, for example; late running commuter services, traffic or parking difficulties (this is not an exhaustive list). On occasion Zadar Archipelago may act as a managing agent for larger group bookings where boats maybe supplied by alternate companies. In such event you might be asked to check in outside from the Zadar Archipelago Check In Operation Location.
Cancellation policy
Cancellations are a difficult affair for both, us and prospective Guests – you. We therefore try to approach every cancellation case with a ‘common sense’ attitude. We limit our tours to only 12 adult guests per one group and please understand that once you’ve booked, we lose the right to sell your booked space to other individuals or groups. You must be aware that there is a financial implication to cancelling a trip at the last minute as all of our set costs are the same of which many are non-refundable. We also pre-book many of the activities undertaken on the day of your tour, all of which are non-refundable.
No matter what the reason is: (1) Cancellations within less than 48 hours prior scheduled departure of your tour, (2) ‘no show’ or (3) missed tour due to late arrival to the Zadar Archipelago Check In Operation Location and departure point will result in 100% of the total tour price being charged. This means the full cost of the trip or trips booked. You would not only lose the deposit if you paid partially, you would be required to pay the balance stated on your confirmation. You will be asked to pay online, or a driver will be sent to your accommodation to pick this up. If you have booked a group of guests and one or more does not show on the morning of the trip, the person who booked the trip will be required to pay the full balance for missing balance.
If you wish to cancel due to the current weather circumstances, Captain of the boat and / or Tour Leader will advise you and make final decision (according their measurement instruments and Naval Institute forecast) weather particular tour will be delayed, cancelled or preformed. If your personal opinion is in conflict with our team cancellation policy will still stand and 100% of the total tour price is due on the booked tour day.
In the case of your, or members of your group sickness of any sort, we will try to move you to an alternative date, reschedule your tour or offer you another tour, but the cancellation policy still stands and 100% of the total tour price is due on the booked tour day. As we are limited to the number of 12 adult guests on each tour we are often fully booked and a reschedule may not be possible. If you cancel due to sickness and we are unable to place you on another trip due to your travel plans and / or our tours availability, you can go to the doctors and obtain a medical certificate. We can then issue you with an international (English) receipt for the money paid to Zadar Archipelago, all of which can be claimed back from most holiday insurance providers. Please understand that we will not be able to refund to you in case of any sickness.
Zadar Archipelago reserves the right to cancel any tour prior to departure or during the tour for any reason whatsoever, including insufficient sign-ups (minimum number of permitted adult travellers) or logistical problems, weather, Port Authority restrictions and all events which may impede trip operations. If we decide to cancel due to bad weather, we will have done so taking into consideration our Guests’ safety and that of the boat and crew as well as predicted weather forecasts and satellite images taken from weather forecast websites. In such event we will offer alternatives (see more in Modifications & Amendments made by Zadar Archipelago) or refund 100% of the total tour price being charged.
In the event of tour cancellation, Zadar Archipelago is not responsible for expenses incurred by tour members in preparing for a cancelled tour (e.g. visa fees, equipment, non-refundable advance purchase air tickets, etc.) or for any additional arrangements should the tour member have embarked prior to the scheduled group departure date. Zadar Archipelago shall not be liable for (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries, but which may be required to get to and from a trip start or end; (b) expenses due to the delay of a trip for any reason (e.g. bad weather, trail conditions, landslides, flooding, sickness, etc.); (c) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip or in shipping purchases or other goods home from abroad.
Safety standards
Please note, it is the requirements and standards of the country in which any services which make up your travel arrangements are provided which apply to those services and not those of your country of the origin. As a general rule, these requirements and standards will not be the same as those of your country of the origin and may sometimes be lower.

Service Help
In the unlikely event that you have any reason to complain or experience any problems with using our Services, you must immediately inform us in question. Any verbal notification must be put in writing and given to our representative and the supplier as soon as possible, written and sent through the e-mail at: base@zadar-archipelago.com or in given as a written letter in person to us or sent to the address Zadar Archipelago, Obala kneza Trpimira 2, 23000 Zadar, Croatia. Until we know about a problem or complaint, we cannot begin to resolve it.
Most problems can be dealt with quickly, at the spot. If you remain dissatisfied, however, please write to us latest within 5 days of the day your tour finished, giving your booking reference and full details of your complaint. If you fail to follow this simple complaint procedure, your complaints would not be taken as serious and you will be lost as a result.
